The law in Massachusetts regarding dog bites is very specific.
If a dog bites a person, the dog owner or keeper is generally liable for any damages that it incur. However, in order for the owner or keeper to be held liable, the victim must neither have been committing a trespass, nor tease, torment or abuse the dog at the time of injury. In Massachusetts, it is presumed that a child under the age of 7 was not committing a trespass or tormenting or teasing the dog. The burden of proof shifts to the Defendant to prove trespass by a child under the age of 7, or other tort.
It is not unusual for a victim of a dog bite to sustain terrible injuries. A young child bitten by a dog faces the potential of any scarring to become worse. Facial scarring in particular is an issue regarding young child. As a child grows, their facial structure will also grow, thereby potentially elongating any scarring. Additionally, scarring in a young child can become more distorted as the child’s facial growth occurs.
Other types of injuries include punctures, emotional trauma, post-traumatic stress disorder, rabies, etc.
If you are attacked by a dog, you should do the following:
1. Seek immediate medical attention.
2. Report the dog bite or attack to the proper city of town authorities.
3. Photograph the wounded area.
4. Write down the names of any witnesses.
5. Contact an attorney who has experience in handling dog bite cases.

What to do if you caused a Car Crash?
Recently, one of the clients of Chistolini & DeSimone was involved in a very serious car crash. Unfortunately, the client caused the car crash and was subject to a law suit. The family suffered a real threat of losing their home as they did not have adequate insurance. Although the Offices of Chistolini & DeSimone were able to resolve the matter, our client asked, "What can I do so this doesn't happen again?" We explained to the client that nothing can stop someone from bringing a suit or attempting to place a lien or an attachment on your home as a result of a car crash or some other claim.
However, there are steps you can take to protect your home in these troubled economic times. One of those steps is a "Homestead." Massachusetts law provides protection for your principal residence through the Homestead Act. Hopefully, you are never in a car crash. However, we strongly recommend you consider placing a Homestead on your principal residence. We encourage you to contact the Law Offices of Quincy Car Accident Attorneys for a free consultation concerning any type of accident that you may have been in, as well as any rights that you may have under the Homestead Act.
