According to the Center for National Truck Statistics, over 500,000 trucking accidents occur each year in the United States, causing an average of 5,000 fatalities. Big trucks weigh in at 10,000 lbs.+ and any driver or passenger in a standard car that has an accident with one is almost sure to incur injury, sometimes fatal injury.
It's hard to believe the statistics but less than 5% of truck drivers in accidents cite that the truck driver has been drinking, has taken drugs or was drowsy or asleep at the wheel. And almost 85% of truck accidents happen in good weather, meaning no precipitation.
So what does cause catastrophic truck accidents? Here's just a partial list of some of the causes:
· Unlicensed driver
· Inadequately trained driver
· Speeding
· Aggressive driving
· Blown tires
· Loads that shift weight
· Overloaded trucks
· Driver fatigue
· Insufficient maintenance on the vehicle
· Driving while impaired
Because of the weight of big rigs, an accident with one is almost surely to be a bad one. Brian J. Glick of the Glick Law Firm in Baton Raton, FL says, "If you've been injured in an accident with a truck, it's important to contact a lawyer about your legal rights. Different laws apply to truckers and the trucking companies than apply to "regular" drivers."
Depending on the circumstances, the driver, the company the driver works for, the truck manufacturer, or even the company that loaded the truck may be liable for your accident. It's vital that liability be established before trying to collect damages for your medical bills, loss of wages or pain and suffering. Truck companies and their insurance companies have their own investigators and lawyers who will visit the scene, conduct interviews and try to establish your liability. You need someone on your side for legal protection and to discover any trucking company liability. It is a good idea to consult with a law firm before signing a release or accepting an offer of settlement.
Mr. Glick suggests, "Meet with an attorney if you or a loved one have been injured or involved in a fatal accident with a big rig. It could be the most important step in recovering compensation for your losses."
